1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tiny Echo Limited ("Company," "we," "us," or "our") governing your access to and use of Webattle (the "Service"), including any content, functionality, and services offered at webattle.ai.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Webattle is an AI-powered creature creation and battle platform that allows users to:

• Create AI-generated digital creatures ("Buddies") based on text descriptions
• Engage in simulated battles between Buddies
• Collect, customize, and manage their Buddy collection
• Earn and spend virtual currencies (gold and diamonds)
• Purchase subscription plans for enhanced features

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover any unauthorized use of your account

You must be at least 13 years old to create an account. By creating an account, you represent that you are at least 13 years old.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer subscription plans (Elite and Master) that provide additional features and benefits. Subscription fees are billed in advance on a monthly or yearly basis depending on the plan you select.

4.2 Payment Processing

Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fees. You are responsible for providing accurate payment information and ensuring your payment method remains valid.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Upon cancellation, you will retain access to subscription benefits until the end of your current billing period. Refunds are generally not provided for partial subscription periods, except as required by law.

4.4 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.

5. Virtual Currency and Items

The Service includes virtual currencies (gold and diamonds) and virtual items (equipment, Buddies). These virtual items:

• Have no real-world monetary value
• Cannot be exchanged for real money or transferred to others
• Are licensed to you, not sold
• May be modified, removed, or reset at our discretion

We reserve the right to manage, regulate, control, modify, or eliminate virtual currencies and items as we see fit. We shall have no liability to you or any third party for the exercise of such rights.

6. User Content

6.1 Your Content

You retain ownership of any content you submit, including text descriptions used to generate Buddies. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

6.2 AI-Generated Content

Content generated by our AI systems (including Buddy images, names, and descriptions) is provided for your personal use within the Service. You may not claim exclusive ownership of AI-generated content or use it in ways that violate these Terms.

6.3 Content Restrictions

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech or promotes discrimination
• Is sexually explicit or pornographic
• Infringes on intellectual property rights
• Contains malicious code or attempts to exploit the Service

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or servers
• Use bots, scripts, or automated methods to access the Service
• Exploit bugs or glitches to gain unfair advantages
• Sell, trade, or transfer your account to another person
• Impersonate another person or entity
• Reverse engineer or attempt to extract source code from the Service

8. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Tiny Echo Limited and are protected by international copyright, trademark, patent, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. AI-generated content may contain errors or inaccuracies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY ECHO LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tiny Echo Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may delete your account at any time by contacting us. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
